Georgia Immigration Attorney Denied Motion for Postponement Despite Giving Birth to Child

In the judicial system of the United States, there are many good reasons why a court case may need a delay or postponement. Apparently, an Atlanta, Georgia Immigration Judge does not think that child birth is an acceptable reason for an attorney to ask for a new court date. Stacy Ehrisman-Mickle is an immigration attorney who had agreed to take on the case of two young boys trying to obtain legal status in the U.S. Ehrisman-Mickle accepted the case knowing that the court date would land during her maternity leave. In the past, she had never had a problem with any judge denying her motions for postponement.

The Atlanta-based attorney filed her motion, but when it was surprisingly denied by the judge (Judge J. Dan Pelletier Sr.), Ehrisman-Mickle had to come up with a new plan. With her husband away, and the rest of her family unavailable to care for her newborn, she decided to bring the 4 week old baby to court with her. Under doctor’s orders, she kept the baby tightly strapped to her chest. Unfortunately, during the hearing, the baby began to cry and Judge Pelletier harshly scolded her.
