After Much Anticipation, the Deferred Action Program is Finally Here
Here at our offices, we have been receiving many, many phone calls and emails about the Obama Administration’s Dream Act Deferred Action policy. The forms and more in-depth application information are located on the USCIS website. However, before you send in your Form I-821D or “Consideration of Deferred Action for Childhood Arrivals” application along with the I-765 and I-765 WS forms, think about the following information.
It is advisable to apply RIGHT than to apply early.
This application is important and will allow DREAMers to live and work in the United States without the fear of deportation. It should not be rushed or partially filled out. Applying slowly will prevent possible mistakes that may lead to denial of your request.
As we outlined, one of the many qualifications is“currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States”. You will need to supply evidence to back up your case. For this requirement you should compile documents such as your official high school transcripts, report cards, diploma, GED.
If you think you qualify for Deferred Action, it is a good idea to obtain copies of school records, military records, medical records, financial records and work records so you are properly prepared to support your application and avoid delay.
It is very important to file your application correctly with all honest and true information. If the USCIS finds your information to be false, they will deny your request for Deferred Action and you will not be able to appeal their decision to reopen or reconsider your case. Each application will be examined for possible fraud. If your application is found misrepresented you may be placed in removal proceedings.
